Terms of Use

Last updated: 20 September 2026

These Terms of Use (“Terms”) govern your access to and use of the websites, applications, digital platforms, services, content, tools, and other online properties operated by or on behalf of the Fundamental Wellbeing Foundation, including, without limitation, The Finders platform and application, The Finders website, the Fundamental Wellbeing Foundation website, and any related websites and services that link to or reference these Terms (collectively, the “Services”).

The Services are operated by the Fundamental Wellbeing Foundation, a Wyoming nonprofit corporation recognized as tax-exempt under Section 501(c)(3) of the U.S. Internal Revenue Code (“Foundation,” “we,” “us,” or “our”).

Not every feature described in these Terms is available through every Service. Provisions relating to particular features, such as assessments, artificial intelligence (“AI”), communities, messaging, events, or research, apply only when you access or use those features.

Please read these Terms carefully. By accessing or using the Services, creating an account, or otherwise indicating your acceptance of these Terms, you agree to be bound by them. If you do not agree, do not use the Services.

Your use of the Services is also subject to our Privacy Policy and Disclaimer. In particular, the Disclaimer contains important information concerning the nature of our Services, assessments, artificial intelligence features, health and mental health matters, research, and emergency situations.

1. Eligibility

You must have reached the age of majority and have the legal capacity to enter into a binding agreement in the jurisdiction where you reside to create an account or use portions of the Services that require registration, unless we expressly state otherwise for a particular Service and applicable law permits such use.

By using the Services, you represent and warrant that:

  • you meet the applicable minimum age requirement;
  • you have the legal capacity to enter into these Terms;
  • information you provide to us is accurate and complete to the best of your knowledge; and
  • your use of the Services will comply with applicable law and these Terms.

If we reasonably determine that an account does not meet applicable eligibility requirements, we may restrict, suspend, or terminate access to the account or relevant Services.

2. About Our Services

Depending on the particular Service, we may provide features such as:

  • educational articles, videos, courses, exercises, and other learning materials;

  • AI-powered educational and self-reflection features;
  • member profiles and community discussions;
  • groups, comments, posts, and direct messaging;
  • online and in-person events;
  • wellbeing journaling tools;
  • information about research, studies, findings, and methodologies;
  • opportunities to participate voluntarily in research;
  • Foundation news, publications, resources, and activities;
  • donation functionality; and
  • other educational, research, wellbeing, community, or related functionality.

The availability and nature of these Services may change over time.

3. Educational and Wellbeing Purposes; No Professional Services

Certain Services address wellbeing, personal experiences, mental states, or related subjects. These Services are provided for educational, general wellbeing, and research purposes.

THE SERVICES ARE NOT MEDICAL, PSYCHIATRIC, PSYCHOLOGICAL, THERAPEUTIC, COUNSELING, OR OTHER HEALTHCARE SERVICES ADVICE.

Nothing provided through the Services is intended to diagnose, treat, cure, mitigate, or prevent any disease, disorder, medical condition, or mental health condition, or to replace advice, diagnosis, treatment, or care from an appropriately qualified professional.

Information obtained through our Services, including educational materials, assessments, AI-generated responses, community discussions, programs, exercises, and research-related materials, does not constitute medical, psychological, psychiatric, therapeutic, or other professional healthcare advice.

Use of the Services does not create a doctor-patient, therapist-client, psychologist-patient, counselor-client, or other healthcare professional relationship.

You should seek advice from an appropriately qualified healthcare professional regarding medical or mental health concerns and before making decisions or changes relating to your health, medication, treatment, or care.

Please review our important Disclaimer for additional information.

THE SERVICES ARE NOT EMERGENCY OR CRISIS SERVICES AND ARE NOT DESIGNED TO MONITOR, IDENTIFY, OR RESPOND TO EMERGENCIES.

IF IN DANGER CONTACT EMERGENCY SERVICES IMMEDIATELY.

If you believe that you or another person may be in immediate danger, may harm themselves or others, or requires urgent medical or mental health assistance, contact appropriate local emergency services or an appropriately qualified emergency or healthcare provider immediately.

Do not rely on the Services, AI features, community members, Foundation personnel, or other users for emergency assistance.

4. Assessments and Educational Tools

Certain Services may provide assessments, questionnaires, evaluations, classifications, exercises, self-reflection tools, or similar features.

These tools are intended for education, personal insight, self-reflection, general wellbeing exploration, and/or research only.

You understand and acknowledge that:

  • ASSESSMENTS ARE NOT CLINICAL OR DIAGNOSTIC INSTRUMENTS;
  • assessment results do not constitute medical or mental health diagnoses;
  • results should not be used as the sole basis for medical, mental health, medication, treatment, or other important health decisions;
  • assessments cannot fully capture the complexity of an individual’s experiences;
  • classifications, descriptions, scores, or results may not accurately describe every individual;
  • individual experiences may vary substantially; and
  • we do not guarantee any particular assessment result, interpretation, experience, improvement, state, or outcome.

Assessments and educational materials may draw upon research, theories, models, methodologies, and frameworks relating to Fundamental Wellbeing and associated fields.

References to research, researchers, publications, theories, or frameworks do not by themselves mean that a particular assessment, interpretation, theory, framework, or conclusion has been universally accepted, clinically validated, or endorsed by governmental, scientific, medical, psychological, or other professional authorities.

5. Research

The Foundation may conduct, sponsor, support, facilitate, collaborate on, or provide access to research concerning Fundamental Wellbeing and related subjects.

Voluntary Participation

Participation in research is voluntary.

Where a particular activity constitutes participation in a research study, additional information may be provided concerning matters such as:

  • the purpose and nature of the study;
  • eligibility requirements;
  • what participation involves;
  • potential risks or benefits;
  • use of information;
  • privacy and confidentiality;
  • consent;
  • withdrawal from participation; and
  • contact information for study-related questions.

Where applicable, study-specific consent forms, research notices, protocols, or other terms will apply in addition to these Terms and will govern the particular research activity to which they relate.

Merely visiting one of our websites, maintaining an account, completing an educational assessment, or accessing educational content does not necessarily mean that you are participating in a research study.

However, to the extent permitted by applicable law and as described in our Privacy Policy, we may use information derived from your use of the Services for research, scientific, statistical, and analytical purposes where that information has been aggregated or anonymized so that it does not identify you and cannot reasonably be linked back to you. Such anonymized or aggregated information may be used for these purposes without obtaining additional consent from you, unless applicable law or study-specific requirements provide otherwise.

Where information collected through the Services may be used for research, such collection and use will be subject to applicable disclosures, consent requirements, our Privacy Policy, study-specific documentation where applicable, and applicable law.

Declining an invitation to participate in research will not affect access to unrelated Services, except where the relevant feature or activity is itself part of the research.

6. Artificial Intelligence Features

Certain Services may include features powered by artificial intelligence, machine learning, large language models, or similar technologies (“AI Features”).

AI Features are intended primarily for educational, informational, exploratory, and self-reflection purposes.

You acknowledge that AI-generated responses and other AI-generated content:

  • are produced automatically;
  • may contain factual errors;
  • may be inaccurate, incomplete, outdated, misleading, inappropriate, inconsistent, or irrelevant;
  • may misunderstand information, context, or intent;
  • may present uncertain information confidently;
  • may produce different responses to similar questions; and
  • should not automatically be treated as factual or authoritative.

AI-GENERATED CONTENT DOES NOT CONSTITUTE MEDICAL, PSYCHOLOGICAL, PSYCHIATRIC, THERAPEUTIC, LEGAL, FINANCIAL, OR OTHER PROFESSIONAL ADVICE.

You must not rely solely on AI Features to:

  • diagnose a medical or mental health condition;
  • determine or change treatment;
  • start, stop, or modify medication;
  • respond to an emergency or crisis;
  • make safety-critical decisions; or
  • make other significant decisions that reasonably require professional expertise.

You are responsible for exercising independent judgment when considering AI-generated content and for seeking qualified professional advice when appropriate.

We may implement technical, editorial, or other safeguards intended to reduce inaccurate, inappropriate, or harmful AI responses. However, we cannot guarantee that safeguards will identify, prevent, or correct every problematic response.

Additional notices, disclaimers, consent mechanisms, or usage requirements may apply to particular AI Features.

7. Accounts and Account Security

Certain Services require you to create an account.

When creating or maintaining an account, you agree to:

  • provide accurate and reasonably current information;
  • keep your login credentials confidential;
  • take reasonable steps to protect your account against unauthorized access;
  • not knowingly permit another person to use your account as their own;
  • promptly notify us if you reasonably believe that your account or credentials have been compromised; and
  • accept responsibility for activity occurring through your account to the extent permitted by applicable law.

Unless expressly authorized otherwise, accounts are intended for individual use.

You may not:

  • impersonate another person;
  • misrepresent your identity or affiliation;
  • create an account using information you are not authorized to use;
  • create accounts for deceptive, fraudulent, abusive, or unlawful purposes; or
  • create another account for the purpose of circumventing a suspension, restriction, or termination.

We may take reasonable steps to verify account information or investigate suspected misuse, fraud, security issues, or violations of these Terms.

8. Electronic Communications

By creating an account or using certain Services, you understand that we may communicate with you electronically regarding the operation of the Services, including account notices, security alerts, administrative communications, changes to these Terms or other policies, and other service-related matters.

Where required by applicable law, marketing communications, newsletters, promotional emails, or similar communications will be sent only with the appropriate consent or other lawful basis.

You may unsubscribe from marketing communications using the mechanism provided in those communications or by the Services. Unsubscribing from marketing messages does not necessarily prevent us from sending essential administrative, transactional, security, or legal notices relating to your account or use of the Services.

9. Acceptable Use

You may use the Services only for lawful purposes and in accordance with these Terms.

You agree not to use the Services to:

  • violate applicable law, regulation, court order, or legally enforceable requirement;
  • infringe or violate another person’s rights;
  • threaten, harass, intimidate, stalk, exploit, abuse, or harm another person;
  • encourage or facilitate violence, exploitation, or unlawful conduct;
  • deliberately distribute fraudulent, deceptive, or materially misleading information;
  • impersonate another individual or organization;
  • falsely claim an affiliation, qualification, credential, or professional status;
  • provide regulated medical, psychological, therapeutic, legal, financial, or other professional services through the Services where you are not lawfully authorized to do so;
  • solicit passwords, authentication credentials, financial information, or other sensitive information from users for improper purposes;
  • disclose another person’s private or confidential information without authorization;
  • distribute spam, unsolicited advertising, promotions, or commercial solicitations except where expressly authorized by us;
  • upload, transmit, or distribute viruses, malware, malicious code, or other harmful technologies;
  • disrupt or interfere with the operation or security of the Services;
  • probe, scan, test, defeat, or circumvent security, authentication, rate limitations, or access controls;
  • gain or attempt to gain unauthorized access to accounts, systems, networks, databases, or information;
  • scrape, crawl, harvest, index, systematically extract, or collect Service content or user information by automated means except where expressly authorized by us or permitted by applicable law;
  • operate bots or automated systems in a manner that places an unreasonable burden on the Services or interferes with their normal operation;
  • reverse engineer, decompile, disassemble, or attempt to derive source code or underlying technology from the Services except where applicable law expressly permits such activity;
  • remove or circumvent copyright, trademark, attribution, technical protection, or other proprietary notices or measures;
  • reproduce or distribute copyrighted or proprietary material without authorization;
  • use Foundation Content to develop, train, fine-tune, improve, or benchmark an artificial intelligence or machine-learning model without our prior written permission, except where such restriction is prohibited by applicable law;
  • use information obtained through the Services to create unauthorized databases, directories, mailing lists, or member profiles; or
  • assist or encourage another person to engage in conduct prohibited by these Terms.

We may investigate suspected violations and take reasonable measures to protect users, the Foundation, third parties, and the Services.

10. Community Features

Certain Services may include community features such as profiles, posts, comments, discussions, groups, reactions, direct messages, events, or other means of interacting with users.

Respectful Participation

When participating in community features, you agree to interact with others respectfully and responsibly.

You should not:

  • harass or abuse other users;
  • deliberately provoke, threaten, intimidate, or shame others;
  • publish another person’s private information without permission;
  • engage in spam or unauthorized commercial promotion;
  • misrepresent your qualifications or authority;
  • present personal opinions as professional medical or therapeutic advice; or
  • use the community to exploit vulnerable users.

We may maintain additional Community Guidelines or feature-specific rules. Where provided, those rules form part of the conditions governing your use of the relevant community feature.

Community Members Are Not Professional Advisors

Statements, recommendations, experiences, and opinions shared by community members generally represent the views of the person who submitted them.

Community members are not acting on behalf of the Foundation and should not be assumed to be physicians, therapists, psychologists, counselors, researchers, or other qualified professionals.

We do not guarantee the accuracy, reliability, qualifications, safety, or appropriateness of information or advice provided by users.

Community discussion and peer support are not substitutes for qualified professional care.

11. User Content

The Services may allow you to create profiles, submit assessment responses, publish posts, make comments, participate in discussions, upload materials, exchange messages, or otherwise submit information or content (“User Content”).

Your Responsibility for User Content

You are responsible for the User Content you submit and for deciding what information you choose to share.

You represent and warrant that:

  • you have the rights and permissions reasonably necessary to submit your User Content;
  • your User Content does not unlawfully infringe another person’s rights; and
  • your submission and our permitted use of the User Content under these Terms will not violate applicable law.

Think carefully before sharing sensitive personal, medical, mental health, financial, confidential, contact, or identifying information with other users.

Content shared in community areas may be visible to other users and/or public and/or search engines according to the design and privacy settings of the relevant feature. Other users may be able to view, discuss, quote, screenshot, copy, or otherwise interact with information you voluntarily disclose, and we cannot fully control what other individuals do with information they receive.

12. License to User Content

By submitting User Content through the Services, you grant the Foundation a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use that User Content to the extent reasonably necessary to:

  • operate and provide the Services;
  • make your User Content available through features you intentionally use;
  • maintain and secure the Services;
  • provide customer or technical support;
  • moderate content and enforce these Terms;
  • prevent fraud, abuse, or security incidents; and
  • comply with applicable law.

This license does not transfer ownership of your User Content to the Foundation.

Where you intentionally publish User Content to a community or shared area, this license includes the right to make the content available to the audience inherent in or selected through that feature.

The license generally ends when the relevant User Content is deleted from our active systems, except where continued retention or processing is reasonably necessary:

  • to comply with law or legal obligations;
  • for security, fraud prevention, or enforcement;
  • to resolve disputes;
  • because the content forms part of records we are permitted or required to retain; or
  • because copies temporarily remain in backups and are removed through our normal backup-retention processes.

Use of information for research purposes is separately subject to applicable research disclosures, consent requirements, our Privacy Policy, study-specific documentation where applicable, and applicable law.

13. Moderation and Enforcement

We may, but are not obligated to, monitor, review, investigate, restrict, remove, preserve, or take other action concerning User Content or account activity where we reasonably believe doing so is appropriate to:

  • protect users or other persons;
  • enforce these Terms or Community Guidelines;
  • investigate complaints;
  • prevent abuse, fraud, exploitation, or unlawful activity;
  • maintain security or integrity;
  • operate and support the Services; or
  • comply with applicable law or valid legal process.

Automated and Pre-Moderation Review

We may use automated systems, including keyword detection, pattern recognition, rule-based triggers, and artificial intelligence tools, to help identify content that may violate these Terms, Community Guidelines, safety standards, or other applicable rules.

Where content is flagged by these systems as potentially harmful, dangerous, inappropriate, or otherwise requiring additional review, we may temporarily withhold that content from publication and route it for manual review before it becomes visible to other users.

Automated systems are used to assist moderation and may produce false positives or fail to identify problematic content. The Foundation does not guarantee that all harmful, inappropriate, unlawful, or concerning content will be detected, flagged, reviewed, or prevented from being published.

The availability of moderation, reporting, or safety features does not mean that we review all content, communications, or interactions.

We do not guarantee that inaccurate, offensive, inappropriate, harmful, unlawful, or otherwise objectionable content will always be detected or removed.

We may take action based on context, severity, frequency, risk, and other relevant circumstances.

14. Direct Messages and Private Communications

Certain Services may allow users to communicate directly.

Direct messages are intended to be accessible to participants in the relevant conversation, but they are not end-to-end encrypted unless we expressly state otherwise.

To the extent permitted by applicable law and consistent with our Privacy Policy, we may access, preserve, review, or disclose messages and related information where reasonably necessary to:

  • investigate reports of abuse, threats, exploitation, fraud, or misconduct;
  • protect users or other persons;
  • maintain security;
  • provide requested technical or customer support;
  • enforce these Terms; or
  • comply with applicable law or valid legal process.

Do not use community messaging features to transmit information that requires legally privileged, medical-grade, financial-grade, or other specialized confidential communications unless we expressly indicate that the relevant Service is designed for that purpose.

15. Groups, Events, and Interactions Between Users

Certain Services may facilitate groups, virtual events, in-person events, collaborative activities, introductions, or interactions between users.

Unless expressly stated otherwise, the Foundation does not:

  • independently verify the identity or background of every user;
  • verify every statement made by users;
  • guarantee the qualifications claimed by users;
  • guarantee the accuracy of user-created event information; or
  • guarantee the conduct, availability, compatibility, reliability, or safety of other users.

Users who create or publish events are responsible for providing reasonably accurate and lawful information and for having authorization to share any meeting links, addresses, materials, or other information they publish.

If you choose to meet or interact with another user outside the Services, you are responsible for exercising reasonable judgment and appropriate safety precautions.

Foundation-organized events may be subject to additional participation terms, waivers, policies, registration requirements, or notices. Those additional terms apply to the relevant event.

16. Foundation Content and Intellectual Property

The Services and materials made available by or on behalf of the Foundation may include software, interfaces, designs, trademarks, logos, names, text, graphics, photographs, illustrations, video, audio, educational materials, assessments, questionnaires, methodologies, databases, compilations, and other content (“Foundation Content”).

Foundation Content may be protected by copyright, trademark, database, trade secret, and other intellectual property or proprietary-rights laws.

Unless expressly stated otherwise, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use Foundation Content for your lawful personal, educational, and non-commercial use.

Except where expressly permitted by us or applicable law, you may not:

  • reproduce;
  • republish;
  • distribute;
  • sell;
  • sublicense;
  • commercially exploit;
  • publicly display;
  • substantially modify;
  • create unauthorized derivative works from; or
  • systematically extract

Foundation Content without authorization from the applicable rights holder.

The Services may also contain content owned or licensed by researchers, authors, partners, licensors, users, or other third parties. Rights in such content remain with the applicable rights holders.

Nothing in these Terms transfers ownership of Foundation intellectual property to you.

17. Feedback and Suggestions

If you voluntarily provide ideas, suggestions, comments, feature requests, or other feedback about the Services (“Feedback”), you agree that the Foundation may use that Feedback without restriction or compensation to you.

This does not give us a right to use personal information contrary to our Privacy Policy.

Please do not submit confidential or proprietary information as general Feedback unless appropriate confidentiality arrangements have been made separately.

18. Privacy and Data Protection

Our Privacy Policy explains how we collect, use, disclose, retain, and otherwise process personal information in connection with the Services, as well as rights that may be available to individuals under applicable law.

Please review the Privacy Policy carefully, particularly before providing information relating to wellbeing or other potentially sensitive matters.

Where applicable law requires consent for a particular processing activity, consent will be requested separately as appropriate.

19. Third-Party Services and Links

The Services may include links to, integrations with, embedded content from, or functionality provided by third parties, including payment providers, AI technology providers, video platforms, analytics providers, hosting providers, event platforms, social networks, or other websites and services.

Third-party services are generally governed by their own terms, policies, and privacy practices.

The Foundation does not control third-party services merely because they are linked, referenced, embedded, or integrated into our Services.

We do not accept responsibility for the availability, content, accuracy, security, products, practices, or services of independent third parties.

The presence of a third-party link, integration, reference, or resource does not constitute endorsement by the Foundation.

You are responsible for reviewing any third-party terms and policies that apply to your use of those services.

20. Mobile Applications and App Stores

Certain Services may be provided through mobile applications distributed by third-party application stores or platforms.

Your download and use of an application may therefore also be subject to the applicable app store’s terms, usage rules, and policies.

Where there is a conflict between these Terms and mandatory terms imposed by an applicable app store with respect to your use of an application distributed through that store, the applicable mandatory app-store terms will apply to the extent of the conflict.

App-store operators are not responsible for the Foundation’s Services except to the extent expressly required by their own terms or applicable law.

Additional application-specific licensing terms may apply and, where applicable, will be made available through the relevant app store or application.

21. Donations

The Foundation is a nonprofit organization and may accept voluntary donations through some of the Services.

Unless we expressly state otherwise:

  • donations are voluntary;
  • donations do not purchase ownership, voting, governance, equity, or membership rights in the Foundation;
  • a donation does not guarantee access to any particular Service, feature, research opportunity, program, result, or benefit;
  • donation amounts do not guarantee preferential treatment or particular outcomes;
  • donations are generally non-refundable except where required by applicable law or where we expressly agree otherwise; and
  • tax treatment or deductibility may depend on applicable law and the donor’s individual circumstances.

Where applicable, we may provide donation receipts or acknowledgments.

You are responsible for obtaining your own tax advice regarding the treatment or deductibility of a donation.

Payments may be processed by independent payment providers and may be subject to their terms and privacy policies.

22. Service Availability and Changes

We aim to keep the Services useful and reasonably available, but we do not guarantee continuous, uninterrupted, secure, or error-free availability.

A Service may be unavailable because of:

  • maintenance;
  • upgrades;
  • technical failures;
  • internet or infrastructure problems;
  • security incidents;
  • third-party services;
  • legal or regulatory requirements;
  • events outside our reasonable control; or
  • other operational circumstances.

We may add, modify, replace, restrict, suspend, or discontinue Services or particular features.

Where reasonably practicable, we may provide advance notice of material changes that substantially affect users. However, advance notice may not be possible or appropriate where changes are necessary for security, legal compliance, abuse prevention, technical reasons, or circumstances outside our reasonable control.

23. Experimental, Beta, and Research Features

We may make experimental, preview, beta, research, pilot, or early-access features available from time to time.

These features may:

  • be incomplete;
  • contain defects or errors;
  • function differently from generally available features;
  • change without notice;
  • produce unexpected results; or
  • be withdrawn or discontinued.

Unless expressly stated otherwise, experimental features are provided for testing, exploration, or evaluation and should not be relied upon for important decisions.

Additional terms or consent requirements may apply to particular experimental or research features.

24. No Guarantee of Results

Experiences relating to Fundamental Wellbeing, personal development, self-reflection, and wellbeing are individual and may differ substantially between people.

We do not guarantee that accessing or using the Services, completing an assessment, participating in a course, exercise, program, event, community, research activity, or other feature, or interacting with an AI Feature will produce any particular insight, experience, state, improvement, benefit, health outcome, or other result.

Testimonials, examples, case studies, research results, descriptions of experiences, or statements from other individuals do not guarantee that you will experience the same or similar results.

25. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL CONTENT, FEATURES, ASSESSMENTS, AI-GENERATED CONTENT, COMMUNITY FEATURES, AND OTHER MATERIALS MADE AVAILABLE THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

To the maximum extent permitted by applicable law, the Foundation disclaims express, implied, and statutory warranties, including warranties of:

  • merchantability;
  • fitness for a particular purpose;
  • accuracy;
  • completeness;
  • availability;
  • reliability;
  • non-infringement; and
  • warranties arising from course of dealing or usage of trade.

We do not warrant that:

  • the Services will always be available, uninterrupted, secure, or error-free;
  • content will always be accurate, complete, current, or appropriate for your circumstances;
  • errors or defects will always be identified or corrected;
  • assessments will accurately characterize your experiences;
  • AI-generated content will be accurate, reliable, safe, or appropriate;
  • other users will act appropriately or truthfully; or
  • use of the Services will produce any particular result.

Nothing in these Terms excludes warranties, rights, remedies, or protections that cannot lawfully be excluded or restricted.

26. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE FOUNDATION AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.

To the maximum extent permitted by applicable law, this limitation includes losses arising from or relating to:

  • reliance on Service content;
  • assessment results;
  • AI-generated content;
  • User Content;
  • interactions with other users;
  • community discussions or messages;
  • third-party content or services;
  • unauthorized access to or alteration of your account or communications;
  • interruption or unavailability of the Services;
  • loss or corruption of information; or
  • acts or omissions of independent third parties.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law, including any liability that cannot lawfully be excluded or limited.

27. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless the Foundation and its directors, officers, employees, volunteers, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable costs arising directly from or relating to:

  • your unlawful use of the Services;
  • your material violation of these Terms;
  • User Content you submit;
  • your infringement or violation of another person’s rights; or
  • your unlawful or intentionally harmful conduct toward another user.

This provision does not require you to indemnify the Foundation for conduct for which indemnification cannot lawfully be required or for liabilities caused by the Foundation to the extent applicable law places responsibility on the Foundation.

28. Suspension and Termination

You may stop using the Services at any time.

Where account-deletion functionality is available, you may request deletion in accordance with the applicable Service and our Privacy Policy.

We may restrict, suspend, or terminate access to some or all Services where we reasonably believe that:

  • you have materially or repeatedly violated these Terms;
  • your use presents a safety, security, legal, or operational risk;
  • your conduct threatens, exploits, or materially harms another person;
  • your account is being used fraudulently or without authorization;
  • you have attempted to circumvent previous restrictions;
  • action is required by applicable law or valid legal process; or
  • continued access would expose the Foundation, users, or others to material risk.

We may, but are not obligated to, restrict, suspend, or terminate access to some or all of the Services if a user’s content, communications, conduct, or use of the Services raises serious concerns regarding safety or wellbeing, or if we otherwise determine that continued access to the Services may be inappropriate.

The Foundation does not undertake or assume any obligation to monitor users, identify or assess medical or mental health conditions or crises, determine whether professional or emergency intervention is required, or provide emergency monitoring or response. Users must not rely on the Foundation or the Services to detect or respond to a medical or mental health emergency. Any action taken, or not taken, under this provision does not constitute a medical or mental health assessment, diagnosis, or professional judgment.

Where appropriate and reasonably practicable, we may provide notice or an opportunity to address a violation before termination.

We may act without advance notice where we reasonably believe immediate action is necessary to protect users, security, legal compliance, the Foundation, or third parties.

Termination does not affect provisions that by their nature should continue after termination, including provisions concerning intellectual property, User Content already lawfully retained, warranty disclaimers, liability limitations, indemnification, and dispute-related provisions.

Retention and deletion of personal information are governed by our Privacy Policy and applicable law.

29. Copyright and Intellectual Property Complaints

We respect intellectual property rights and expect users to do the same.

If you believe that content available through the Services infringes copyright or other intellectual property rights, you may contact us at legal@thefinders.org and provide sufficient information for us to identify:

  • the work or right you believe has been infringed;
  • the content you believe is infringing;
  • where the relevant content appears;
  • your contact information; and
  • the basis for your claim.

We may remove or restrict access to allegedly infringing material where appropriate.

We may restrict or terminate accounts of users who repeatedly infringe intellectual property rights in appropriate circumstances.

Where applicable, we may maintain additional procedures for copyright notices and counter-notices in accordance with applicable law.

30. Changes to These Terms

We may update these Terms from time to time to reflect changes to:

  • the Services;
  • Foundation activities;
  • applicable laws or regulations;
  • technology;
  • security requirements;
  • research or community functionality; or
  • our operational practices.

The “Last updated” date at the beginning of these Terms identifies the latest revision.

If we make material changes, we will provide reasonable notice where required or appropriate, which may include notice through the Services, an account notification, or email.

Where applicable law requires affirmative consent to revised terms, we will request that consent.

Otherwise, continued use of the Services after revised Terms take effect constitutes acceptance of the revised Terms to the extent permitted by applicable law.

If you do not agree to revised Terms, you should discontinue use of the affected Services.

31. Governing Law and Jurisdiction

These Terms and disputes arising out of or relating to them or the Services will be governed by the laws of the State of Wyoming, United States.

Subject to mandatory legal rights or jurisdictional requirements that cannot lawfully be waived, you and the Foundation agree that disputes arising from these Terms or the Services may be brought in the state or federal courts having appropriate jurisdiction in Wyoming, United States, and each party consents to the jurisdiction of those courts.

Nothing in this section deprives a consumer of mandatory rights, remedies, protections, or jurisdiction available under the laws of the consumer’s place of residence where those rights cannot lawfully be waived or restricted by contract.

32. International Use

The Services may be accessible from countries and regions outside the United States.

The Foundation does not represent that every Service, feature, or item of content is appropriate, permitted, or available in every jurisdiction.

You are responsible for complying with laws applicable to your use of the Services in your location.

We may restrict the availability of some or all Services in particular jurisdictions where reasonably necessary for legal, regulatory, technical, security, or operational reasons.

Nothing in these Terms limits mandatory consumer, privacy, data-protection, or other statutory rights that apply to you and cannot lawfully be waived.

33. Additional Terms for Particular Services
